These Terms and Conditions, together with any and all other documents referred to herein, set out the terms of use under which you may use this website, justfix.app (“Our Site”). Please read these Terms and Conditions carefully and ensure that you understand them.

Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of Our Site. If you do not agree to comply with and be bound by these Terms and Conditions, you must stop using Our Site immediately.

You are signing up to the Just Fix network of Fixers

 

  • You will be representing Just Fix and will be expected to maintain high standards of language, behaviour, presentation and professionalism:-

    • Park considerately at the address, you are responsible for all parking tickets, fines, tolls, charges, fees etc. etc whilst at the customers address. Vehicles should be insured, roadworthy, hold a valid MOT certificate and Taxed if relevant. 

    • Follow current UK Health Security Agency (UKHSA) Covid rules (where applicable) or if a customer requests so due to health issues.

    •  Appropriately dressed:-

Clean workwear.

No offensive logos.

Use over-shoe protectors when inside customer property.

Good personal hygiene.

No traces of alcohol or drugs.

Use appropriate safety equipment.

  • Treating customers in a courteous manner at all times and not using offensive (racist, sexist, hetrosexist, gender-ist, classist, ableist, size-ist) or foul language. Customers are in turn expected to treat you in the same manner.

  • Not smoking or vaping in the customers property.

  • Not playing loud/ offensive music at the customers property.

  • Keep the work area tidy at all times.

  • Safe use of tools and equipment to minimise risks of injury to you or occupants at the property (human or animal). 

  • Clean up thoroughly at the end of each work day work prior to leaving site on completion of the work.

  • To protect You, the customer and Just Fix You are required to take photographs to support the before and after position of the work at the property.

  • You are expected to attend the customers property at the agreed time. If you are going to be late for any reason you will be expected to communicate to the customer to manage expectations.

  • The customer is expected to have provided an accurate description of the job booked for you to complete. If there are any errors in the triage/ assignment of the job we will cover Your time in exchange for your assistance in obtaining any further information to ensure we can assign the right person to complete the job for the customer.

  • You will assess if the work can be safely performed, if, for example, a gas central heating boiler is deemed dangerous to you, the customer or the buildings safety or quality parts cannot be sourced to safely repair it to Gas Safe standards you will discuss options with the customer to replace at a competitive price which will be rebooked through the App or WebApp and assigned to you for installation.

  • The customer is expected to ensure you will have safe access to perform the work booked for example scaffolding is deemed necessary for safe performance of high elevation work or restricted access via a loft hatch/ basement/ party wall/ access via a neighbours property, this will need to be provided or organised prior to commencement of the work. We can assist the customer where possible, but there may be instances where we will have to re-book the job at a later date when the requirements are met.

  • The customer will ensure Landlord or Leaseholder approval for works in communal areas, if necessary, is obtained prior to commencement of the work.

  • Data and GDPR. In order to validate your identity and qualifications to provide services to customers we will need to obtain and store certain personal information, for example, name, address, contact details, identity documents, qualifications, trade association memberships, liability/ indemnity cover . This information will be stored in accordance with the Data Protection Act 2018.

  • Just Fix will bill the customer directly for the work performed by You and You will provide an invoice for time, parts & materials (at cost) together with a copy of any parts receipts to enable Us to pay You, the Fixer, for the services performed on our behalf. The customer must pay, via the Just Fix App or WebApp Just Fix for the work performed. We will earn a commission on the work performed being the difference between what the customer pays us (net of VAT) and the amount paid to you via your invoice. It is your responsibility to ensure that you have included all parts and materials (at cost) and labour in your costs to perform the work. We will not be able to retrospectively charge the customer for missed items on the job nor pay You for those missed costs. Customers will provide payment details at the time of booking and payment by debit or credit card will be collected upon accepted completion of the Fix to minimise the risk of non-payment.

  • You will separately attest Your status as self-employed or a sub-contractor through an existing Limited company. You will accept Fix work on a booking by booking basis with each a standalone booking. It is your responsibility to manage your, and/or your company’s Tax obligations. 

  • You or the Company you operate your business through will have appropriate Public Liability Insurance for the Fixer services we will engage you for. You will need to submit the details to your insurer in the event of any claims made by a customer.

  • We operate 24 hours per day, 365 days per annum and as such you may be contacted (via the App or Phone (SMS, WhatsApp, Call)) to attend emergency call-outs at unsociable times of the day or night. Rates may be adjusted to compensate for such events.

 

Internet-connected devices

It may be necessary to obtain information relating to user IDs and passwords in order to work on Internet connected devices or you may need to be provided with access to a tablet or smartphone that the customer will use to operate the device. You must not save this information but must ensure that the customer is made aware of log in details upon completion of the job.

Health and safety

To protect yourself, the customer and their property it is essential that you maintain a safe working environment (as set out by the HSE),  following all safety procedures when using, including but not exclusively, power tools, heat/cold/dust generating equipment or working at heights. You also need to ensure that you are wearing appropriate PPE, for example, but not exclusively, ear protection, eye protection, lung protection, safety footwear, for the FIX you are performing.

Work Quality & Warranty

We pride ourselves in providing a high quality service to our customers. We expect you to provide that high quality service on our behalf. From time to time we may visit a customer site to review the quality of work carried out by you, this could be following a customer comment or complaint or a randomly selected job to review. If the work is not completed to a sufficiently high quality you may be called out to rectify any errors on the job or we may call out another Fixer to correct the work on our behalf. In either case you will be responsible for the associated costs for the remediation work. The work will be guaranteed for a period of 12 (twelve) months from the point of completion of the booked job. The guarantee will cover only work booked and performed by you and paid to Just Fix via the Just Fix platform. Any additional or subsequent work requested or required must be booked in via the App or WebApp and invoiced separately.

Personal behaviour 

Abusive and offensive behaviour will not be tolerated. Any Customer or Fixer complaints will be taken seriously and dealt with accordingly. Serious breaches of behaviour will result in exclusion from the platform - this will range from temporary suspension to permanent exclusion.

Drugs and alcohol

You shall not:

a)  Report, or endeavour to report, for duty at any customer property having just consumed alcohol or under the influence of drugs.

b) Report for duty in an unfit state due to use of alcohol or drug abuse.

c) Be in possession of drugs whilst on duty. 

Drugs, properly prescribed by a general practitioner for medical treatment, are permitted provided such use does not adversely affect Your ability to carry out the work for which You are engaged in a healthy and safe manner. Failure to comply with this requirement will result you being asked to leave the customers property and a replacement Fixer will be sent to complete the Fix.

Treatments are available for alcohol and drug dependency. The NHS and a number of private clinics provide counselling and other services to support addiction. We can provide assistance to support you obtaining treatment for dependency.

Timekeeping

Your and Our reputations are affected by tardiness. Good communications and expectation management are important aspects of providing a good quality service to customers. Habitual lateness or poor communication with us or our customers will lead to sanctions.

Customer ratings

Customers will be asked to rate services provided by you. These trust ratings will be visible on the website and WebApp for future customers to aid their decision making

Customer feedback and faults will be tracked and habitual offenders will be sanctioned by us. We will advise you of proposed investigations, reasons for investigation and timeframe for investigation review, arbitration and final decision on the investigation. The decision of our Chief Fixer is binding and final. We will use a ‘traffic light’ system to track complaints and associated sanctions to enable you to ‘cleanse’ your record and move back to a ‘preferred status’ Fixer. Sanctions can include, but not exclusively be

‘Preferred status’ fixers can in time benefit from accelerated invoice settlement, and other benefits.

Marketing materials

We may from time to time provide you with marketing materials which you are free to use when registered with us. 

General terms and conditions

We reserve the right to transfer/ novate a contract or part of a contract to another legal entity whether connected or not.

We reserve the right to visit a customers property to view the workmanship in the event of a customer complaint, dispute or an ad-hoc quality check.

Changes of ownership or control of a party do not entitle the other party to terminate the contract. 

The contract will be governed by the law of the England and Wales.

In the event of a dispute Just Fix will endeavour to put it right, whether with the initial Fixer or a replacement Fixer. To protect You, the Customer and Us photographs will be taken at their premises to support the before and completed standard of the Fix.

Just Fix and Fixer: Upon acceptance by You to attend the Customers residence to perform the Fix You are contractually obliged to complete the works as requested on the platform. There may be instances where for safety reasons etc. You deem that the work cannot be completed. You will need to assist Us in identifying what course of action needs to be taken to rectify the problem booked by the Customer. If the works are unsatisfactory you will warrant that you will return to the customers property to rectify the problem(s) at your own expense.

We reserve the right to terminate the contract for any reason, for example, but not limited to poor work quality, offensive behaviour etc. etc. You reserve the right to to terminate the contract upon completion of any accepted jobs and any subsequent remedial work. Termination of this contract does not relieve You of responsibility for subsequent remedial work as notified within a reasonable time.

The terms and conditions of this contract are confidential and will not be disclosed to any third party without a separate non-disclosure agreement.

Termination of this contract for any reason does not extinguish all and any responsibilities of the contract up until the termination including any subsequent remedial work.

To facilitate settlement where all parties are not in the same place at the same time the contract between you and us will be executed in a digital format and be legally binding. PDF’s are available if required. Signature may be by way of attesting you agree to the terms and a digital rendering of your name being your signature for this contract or you e-signing a form, either are legally binding.

Any services accepted prior to termination of this contract must be completed to satisfy the full termination of this contract. This includes any remedial work identified in a reasonable period of time and completed at your own expense.

Services and Invoices will be billed in the currency of the country where the work takes place. Payments will be made via Bank Transfer within 14 days of the submission of a fully approved invoices. The customer will be invoiced separately by Us for the work performed by You.

This contract replaces any and all prior agreements between the parties. 

On occasions, due to unforeseen circumstances, we may need to cancel a booking. We will endeavour to provide as much notice as possible to minimise your inconvenience.

You will have the right to return to a Customers property to rectify any issues or complaints by the Customer. If you are unwilling or unable to return we reserve the right to send an alternative Fixer to perform the remediation and you are responsible for these costs and expenses. We reserve the right to recover from You any costs and expenses associated with these remedial works on a Fix you were unable to satisfactorily perform. You will indemnify us for any and all associated costs and any associated recovery costs, including but not exclusively court costs, legal fees. We reserve the right to take legal action to recover these plus reasonable costs incurred in such recovery.

We will subcontract Your services on a job by job basis for Fixes accepted through our platform. You are an independent contractor, representing yourself as a sole trader or through a registered legal entity. You are responsible for accounting for Your own Tax, National Insurance and, if applicable, VAT or the legal entity Corporation Tax, PAYE, National Insurance and if applicable, VAT. 

You are responsible for the work performed at the customers property on Our behalf and will be required to return to the property for any remedial work requested by Us or the Customer.

In the unlikely event of a dispute between Just Fix and you, the courts of England and Wales are recognised as the jurisdiction to settle such disputes for services delivered in the UK, the Channel Islands and the Isle of Man. 

For the avoidance of doubt, English is the language of this contract and delivery of all services in the UK, the Channel Islands and the Isle of Man. Translations into languages other than English at the point of delivery are for customer convenience only and those translations cannot be relied upon in lieu of the terms and conditions of this contract.

There may be instances where it is not possible to complete the Fix as booked, in such cases You will provide us with a detailed list of recommendations to facilitate a Fix which We will share to the Customer.

All contractual notices must be delivered via SMS,Email or WhatsApp to our Chief Fixer any and all notices delivered via alternative methods will not be acknowledged or acted upon.

Other than You and Just Fix, no other party has any authority to legally bind the other parties to this contract.

From time to time we may use Your image or pictures of Your work in Our advertising. To protect You and the Customer You will not be referred to by name, and no locations of the work will be published.

Just Fix reserves the right to set-off any amounts payable to Us (for example related to remediation work that you could not fulfil) prior to settling amounts due to You for other Fixes on the platform.

This instrument contains the entire agreement of the parties with respect to the subject matter hereof and there is no other promise, representation, warranty, usage or course of dealing affecting it. Each party acknowledges that in entering into this contract it does not rely on any statement, representation, or warranty other than those expressly set out in this contract.

Just Fix is guaranteeing the identity of the Fixer booked to perform the job at the customers property. It is imperative that if you accept a customers Fix you are the one that attends the customers property and performs the task. You cannot subcontract the work to an alternative Fixer without using our platform to transfer the Fix to another registered Fixer.

If you sell or assign your rights to this contract to a third party, the third parties rights are bound by the same terms as the original contract.

Until all accepted jobs are completed You are contractually bound by the terms of the contract. You are responsible for reasonable warranty/ remediation obligations during the 12 months following completion of the Fix. Non-disclosure terms remain in effect in perpetuity. 

We reserve the right to suspend your access to new Fix jobs in the event your workmanship or behaviour warrant suspension from the platform. All remaining clauses to the contract will remain in force for the duration of the suspension period.

The contract will remain in force until You or We terminate it. You cannot terminate the contract until all accepted jobs are completed. You are responsible for reasonable warranty/ remediation obligations during the 12 months following completion of the Fix(es). Non-disclosure terms remain in effect in perpetuity. 

We reserve the right to terminate the contract due to a repudiatory or material breach. You are responsible for reasonable warranty/ remediation obligations during the 12 months following completion of the Fix(es). Non-disclosure terms remain in effect in perpetuity.

The contracts are between the booking parties (The Customer, Just Fix, the Fixer). It is the customers responsibility to obtain any necessary approval from a third party (Agent or Landlord). You & We may request confirmation of this approval prior to commencement of a Fix.

It is imperative that You endeavour to attend the customers premises at the agreed time and advise Us if there is a likelihood that you will be late in order to manage the customers expectations and ensure they remain a satisfied customer. Habitual tardiness may result in sanctions, suspension or termination of your Fixer status.

This contract cannot be amended or varied by means other than the signing of a replacement contract.

No failure by any party to insist upon the strict performance of any covenant, duty, agreement or condition of this Agreement or to exercise any right or remedy consequent upon a breach thereof shall constitute a waiver of any such breach or any other covenant, duty, agreement or condition.

  • We will provide a highly skilled Fixer to work on the booked job at Your property.

  • Our Fixer will assess if the work can be safely performed, if, for example, a gas central heating boiler is deemed dangerous to Your, the Fixer or the buildings safety or parts cannot be sourced to safely repair it to Gas Safe standards the Fixer will discuss options with you to replace at a competitive price which will be booked for installation via the App or WebApp.

  • Our Fixers will need safe access to perform the work booked, for example scaffolding is deemed necessary for safe performance of high elevation work or challenges due to restricted access via a loft hatch/ basement/ party wall/ access via a neighbours property, this will need to be provided, advised or organised prior to commencement of the work. We can assist where possible to facilitate this, but there may be occasions when a job will need to be rescheduled to ensure the safety of You, Your property and our Fixers.

  • Payment is made to Us in GBP by credit card or debit card via the Just Fix platform. Payments will only be released to the Fixer upon acceptance of the completed job, payments for services outside the UK will be charged in the local currency of the country unless agreed otherwise. A small deposit charge is taken at the time of booking. Payment will not be made to the Fixer for the Fix until completed and accepted by You. The balance will be collected using the card details on file upon completion of the Fix.

  • You will ensure Landlord or Leaseholder approval for works in communal areas if necessary is obtained prior to commencement of the work.

  • You will provide, to the best of your ability and knowledge, an accurate description of the work required as incorrect descriptions may delay the commencement of work or require a different Fixer to attend to complete the job.

  • Our Fixers are expected to maintain high standards of behaviour, presentation and professionalism at all times at your property.

  • Our Fixer is expected to clean up after themselves at the end of each day on site and on completion of the work.

  • To protect you, the Fixer and Just Fix, the Fixer is required to take photographs to support the before and after position of the work at the property.

  • We expect You and the Fixers to treat each other in a courteous manner at all times and not use offensive (racist, sexist, hetrosexist, gender-ist, classist, ableist, size-ist) or foul language. 

  • Fixers will be asked to rate customers. These trust ratings will be visible on the website and WebApp for future Fixers to aid their decision making to accept a job.

  • Data and GDPR. In order to provide You with the best possible service we will need to obtain and store certain personal information, for example, name, address, contact details and photographs of work completed. This information will be stored for no longer than necessary and in accordance with the Data Protection Act 2018.

Internet-connected devices

It may be necessary to share information relating to user IDs and passwords in order to work on Internet connected devices or You may need to provide access to a tablet or smartphone that you will use to operate the device. The Fixer will not save this information but will ensure that You are made aware of log in details upon completion of the job.

The work will be guaranteed for a period of 12 (twelve) months from the point of payment for the completed booked job. The guarantee will cover only work booked via the Just Fix platform, performed by the Fixer, paid to Just Fix via the Just Fix platform and a review posted on the Just Fix platform of the work performed. Any additional or subsequent repairs requested or required must be booked in via the App or WebApp platform and will be invoiced and charged separately.

Your Just Fix Fix, guaranteed

We will help make things better if the Fix doesn’t go as planned.

In the unlikely event that a Just Fix Fix doesn’t solve the problem we will work with you to put it right. Book through our Just Fix platform and your Fix will be guaranteed for a period of 12 (twelve) months. Our guarantee covers you for the work performed. Claims for parts will be made by you under the manufacturers warranties. This excludes unconnected issues which may arise, or have arisen (we will work with you to fix these, but they will not be covered by the guarantee). Subject to a limit of £1,000 per claim.

Please read the terms and conditions below in full to understand what is required to make a claim under our guarantee.

We have made it easy with these simple steps:-

Book the Fix through our platform, Fix is performed by the designated Fixer and Payment made by debit or credit card via the platform.

Keep a note of the job and date performed. this will help us find it quickly if you need to claim.

Upon completion of the work, accept the work is complete this may be via phone, sms, WhatsApp or the Just Fix App.

In the unlikely event that something does go wrong, please contact us at the earliest opportunity to allow the Fixer the chance to put it right before making a claim under our guarantee. Notification must be within the warranty period

Health and safety

For Your, Your property and our Fixers safety You may be asked to keep a safe distance from the work area. The Fixer may refuse to continue to work on the booked job if You fail to comply with this requirement in order to minimise the risk of causing injury to You or the Fixer. Please follow any safety instructions accordingly.

Personal behaviour

Just Fix and Customer: Upon acceptance of the Fixer to provide the work We are contractually obliged to complete the works as requested unless for safety or other reasons we ascertain that we cannot complete the work. Upon completion of the work by the Fixer you are contractually obliged to pay for the agreed works. 

The terms and conditions of this contract are confidential and will not be disclosed to any third party without a separate non-disclosure agreement.

Termination of this contract for any reason does not extinguish all and any responsibilities of the contract up until the termination including payment for any works performed and enabling access to the property for any subsequent remedial work.

Just Fix retains the ownership of equipment and materials supplied until paid in full. Just Fix reserves the right to take legal action to recover such property in the event of an outstanding debt. 

Due to the nature of some work it may be necessary to leave tools, equipment and materials at Your premises overnight. To ensure the safety of all occupants at Your premises and minimise any risks of injury please keep people and pets away from the work area. There is also a risk of damage to the Fixers tools, equipment and materials if they are touched by people or animals on site. If such damage is deemed to be due to unauthorised interference We reserve the right to recover the costs and expenses associated with repair or replacement of tools, equipment or materials.

Providing reliable Fixers and great customer service is our priority. If anything goes wrong we will work with you to put it right, whether this is by the original Fixer or, if they are not available, an equally well qualified Fixer.

We will guarantee all works for a period of 12 months from the date of completion, manufacturer warranties will apply for parts.

If there is an issue with a Fix the original Fixer will have the right to return to Your property to rectify any issues or complaints. If the original Fixer is unwilling or unable to return we reserve the right to send an alternative Fixer to perform the remediation work.

If You are not the owner of the property the Fix is booked for You are responsible for ensuring that all any any approvals are in place prior to the commencement of the work by Us. Approvals may be required from, including but not exclusively, the Agent, Landlord, Council planning office, Insurer.

Just Fix is guaranteeing the identity of the Fixer booked to perform the Fix at Your property. If the Fixer does not match the one booked please contact the office immediately to discuss next steps prior to letting them into Your property.

If you sell or assign your rights to this contract to a third party, the third parties rights are bound by the same terms as the original contract.

Until all accepted jobs are completed You are contractually bound by the terms of the contract. Non-disclosure terms remain in effect in perpetuity. 

We reserve the right to suspend your access to book new Fix jobs in the event You seriously misrepresent works required or your behaviour warrants suspension from the platform. All remaining clauses to the contract will remain in force for the duration of the suspension period.

The contract will remain in force until You or We terminate it. You cannot terminate the contract until all completed jobs are fully paid. Non-disclosure terms remain in effect in perpetuity. 

The contract is between the booking parties (You The Customer, Just Fix, the Fixer). It is the Your responsibility to obtain any necessary approval from a third party (Agent, Landlord etc). We may request confirmation of this approval prior to commencement of a Fix.

It is imperative that You endeavour to meet the Fixer at the property to ensure work can commence at the agreed time and advise Us if there is a likelihood that you will be late in order to manage the Fixers timetable. We reserve the right to charge the full cost of the Fix for a missed appointment. Habitual tardiness may result in suspension from the platform.

This contract cannot be amended or varied by means other than the signing of a replacement contract.

No failure by any party to insist upon the strict performance of any covenant, duty, agreement or condition of this Agreement or to exercise any right or remedy consequent upon a breach thereof shall constitute a waiver of any such breach or any other covenant, duty, agreement or condition.
